General Terms and Conditions

Version of October 15, 2026. This English version is provided for convenience; the German version prevails.

1. Scope

These Terms apply to all orders placed via the Edelweiss Webdesign website, a service of Cavaler Media GmbH, Kelmattstrasse 11, 6403 Küssnacht am Rigi, Switzerland (hereinafter “we”). The offer is aimed at businesses. Deviating terms of the customer apply only if we confirm them in writing.

2. Conclusion of the contract

By submitting the inquiry form, the customer requests a quote without obligation. We send the customer a binding quote by email. The contract is concluded when the customer accepts the quote (orally during the call or by email) and we confirm the order in writing by email. A signature is not required. We may decline an inquiry without stating reasons, for example if the content is unlawful or does not fit the package.

3. Services

4. Prices and payment

The prices stated in our quote to the customer apply, in Swiss francs (CHF), plus Swiss value added tax at the statutory rate (currently 8.1%). 50% of the order value of the website is payable as a deposit after acceptance of the quote, by QR-bill within 10 days. We begin work once the deposit has been received. We invoice the remaining 50% of the order value of the website and the selected additional services under sections 10 and 10a (second payment) with the final invoice, payable within 10 days of the due date. The second payment is due 4 weeks after receipt of the deposit, or earlier upon acceptance. It remains due even if the website is not finished at that time because content, information, approvals or feedback from the customer are missing. If completion is delayed for reasons attributable to us, the due date is postponed accordingly. We put the website live after receipt of this payment.

5. Process and deadlines

6. Customer content and rights

The customer provides the information in the questionnaire and any logos, images and text. The customer warrants that it holds the rights to them and that the content does not infringe any third-party rights. The customer indemnifies us against third-party claims arising from content it has provided. Before the website goes live, the customer checks the text we have written for accuracy, in particular information on services, prices, permits and company data. The templates for the legal notice and privacy policy are no substitute for legal advice; the customer is responsible for their accuracy.

7. Rights of use

Upon payment in full, the customer receives the right, unlimited in time and territory, to use and modify the website for its business, with the exception of the credit under section 8. Royalty-free images are subject to the terms of their source. The domain is registered in the customer's name. We may show the website as a reference after it goes live, unless the customer objects in writing.

8. Credit as creator

Every website we deliver contains a discreet credit naming us as its creator in the footer (with a link marked “nofollow”) and a credit with a link in the legal notice. The credit is part of the offer. The customer undertakes not to remove it. On request, we remove the credit for a one-time surcharge as stated in the quote.

9. Withdrawal

Until we have begun work, the customer may withdraw free of charge; we refund in full any amounts already paid. Once the first draft has been delivered, refunds are excluded.

10. Maintenance and hosting (optional)

10a. Get found locally (optional)

11. Liability

We are liable for damages only in cases of intent or gross negligence. Liability for slight negligence, indirect damages, lost profits and data loss is excluded to the extent permitted by law. In any case, liability is limited to the amount the customer has paid for the order concerned.

12. Data protection

We process personal data in accordance with our Privacy Policy.

13. Governing law and place of jurisdiction

Swiss law applies. The place of jurisdiction is Küssnacht am Rigi, Canton of Schwyz.
